It applies to visitors, customers, prospective customers, and users of the Site, and to individuals who interact with us through our installation partner referral program, customer support channels, and marketing communications.

• Installer referrals: Connecting you, at your request, with an Independent Rhino Installation Partner in your area. See Section 7.2 for important details about this program;
• Shipping and logistics: Coordinating delivery with our carriers across Canada and the United States;
• Marketing communications: Sending promotional emails, discount codes, and product updates to customers and subscribers who have not opted out;
• Abandoned cart communications: Reminding you about items left in your online shopping cart, where permitted;
• Website and product improvement: Analyzing how visitors use the Site to improve its design, content, and product offerings;
• Advertising: Measuring and optimizing our marketing campaigns using the analytics and advertising tools described in Section 5;

5. Cookies and Tracking Technologies

6. Legal Basis for Processing

We collect, use, and disclose personal information based on one or more of the following grounds, consistent with Law 25 and PIPEDA:

• The performance of a contract with you, such as fulfilling an order or a warranty claim;

7. How We Share Your Information

7.1 Service Providers

We share personal information with service providers who process it on our behalf and only for the purposes described in this Policy, including:

• WooCommerce for our e-commerce platform and order management;
• Stripe for payment processing;
• Google Analytics 4 and Google Tag Manager for website analytics;
• Meta Pixel and TikTok Pixel for advertising measurement;
• Shipping and freight carriers for order delivery;

7.2 Independent Rhino Installation Partners

Rhino Pool Borders sells a do-it-yourself product. If you request professional installation, we may refer you to an Independent Rhino Installation Partner operating in your area, where available. Independent Rhino Installation Partners are independent third-party contractors—they are not employees or agents of Rhino Pool Borders. If you request a referral, we will share the contact and project information necessary to make the introduction, such as your name, contact details, and general project details, with the relevant installer.

Once introduced, you contract directly with the Independent Rhino Installation Partner for any labour or installation services, and that partner’s own privacy and business practices govern its handling of your information for that engagement. Rhino Pool Borders remains responsible only for the product itself and the warranties we provide directly, as described in our Warranty Policy.

7.3 Legal Requirements and Protection of Rights

We may disclose personal information where required by law, regulation, court order, or governmental request, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to detect, prevent, or address fraud or security issues.

7.4 Business Transfers

If Rhino Pool Borders is involved in a merger, acquisition, financing, or sale of all or a portion of its assets, personal information may be disclosed or transferred as part of that transaction, subject to appropriate confidentiality protections.

8. Cross-Border Data Transfers

Because we ship to and serve customers in both Canada and the United States, and because some of our service providers—including Stripe, Google, Meta, and TikTok—operate infrastructure outside Québec and Canada, your personal information may be processed or stored outside the province or country in which you reside, including in the United States.

Where your personal information is transferred outside Québec, we conduct or rely on a privacy impact assessment to confirm that the information will receive protection equivalent to that required under Québec law, as required by Law 25, and we take reasonable steps to ensure appropriate contractual protections are in place with our service providers.

9. Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, including:

• The duration of your relationship with us as a customer, plus a reasonable period afterward to address warranty claims—consistent with our two-year limited warranty—returns, accounting, and legal requirements;
• For marketing subscribers, until you unsubscribe or request deletion;
• For website analytics and advertising data, in accordance with the retention settings of the applicable third-party tool, such as GA4’s default or configured retention period.

When personal information is no longer needed for these purposes, we will securely destroy, delete, or anonymize it, subject to any legal obligation to retain it longer.

10. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification. Payment information is processed by Stripe and is not stored on our own servers.

Despite these measures, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

11. Your Privacy Rights

Subject to applicable law, you have the right to:

• Access the personal information we hold about you;
• Request correction of inaccurate or incomplete information;
• Request the deletion of your personal information, where applicable;
• Withdraw consent to our collection, use, or disclosure of your information, subject to legal or contractual restrictions;
• Request information about how your personal information has been used or disclosed, including, where applicable, the categories of third parties to whom it has been disclosed;
• Request the portability of computerized personal information you have provided to us in a structured, commonly used technological format, where required under Law 25;
• Unsubscribe from marketing communications at any time using the unsubscribe link in our emails or by contacting us directly.

13. Marketing Communications

If you provide your email address at checkout, through a sign-up form, or otherwise, we may send you marketing emails, including promotional offers and abandoned cart reminders, where permitted by applicable law and subject to your right to opt out at any time.

Every marketing email will include an unsubscribe mechanism. Transactional communications relating to your order, such as shipping confirmations or warranty correspondence, are not considered marketing and will continue regardless of your marketing preferences.

We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or business operations, including changes to our installation partner program or the tools listed in Section 5.

The updated version will be posted on this page with a revised effective date. Material changes will be communicated as required by applicable law.

18. Governing Law

This Policy is governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, except where mandatory consumer protection laws of a customer’s home jurisdiction, including U.S. state law, apply.
